Dave began his legal career as a trial and defense counsel in the U.S. Navy Judge Advocate General's (JAG) Corps.  He has been in private practice since 1991 and focuses on representing clients in personal injury claims and Veterans Affairs benefits appeals.

Practice Areas

Realizing he wanted to be a lawyer in the tenth grade, David's career has spanned several major areas of practice since he realized his dream. Each has contributed to his current passion for helping people.

Criminal Law. In the Navy, he concentrated on criminal defense in the JAG Corps, later serving as a Trial Counsel and Legal Services Attorney at Naval Air Station Oceana.

Real Estate Development. From 1992 to 2005, David became an award-winning real estate developer, owning several companies and developing and/or building more than 3,000 properties. He used his legal skill to present projects for approval to zoning boards in North Carolina and Virginia.

David's companies collected three Community of the Year awards and shared another from the Tidewater Building Association. Among his prominent award-winning projects in Virginia Beach is the Linkorn Bay Condominiums, a private, swim/boating/outdoor community, and Three Ships Landing, a unique retirement community of 48 homes.

Personal Injury. In 2000, David helped to found Marcari, Russotto, Spencer & Balaban to serve another type of client—people seriously injured in car, truck, motorcycle accidents, slip-and-falls, wrongful death and other cases where he fights for full compensation to help clients rebuild their lives.

Veterans Benefits. His long familiarity with the military and respect for the sacrifices made by veterans were instrumental in David's decision to represent disabled veterans and their families. Until 2008, veterans were not permitted to engage the services of an attorney to apply for benefits.

Today, attorneys may readily be engaged after applicants have been turned down or received an unsatisfactory level of benefits and wish to appeal the VA's decision. David represents veterans across the United States since the Dept. of Veterans Affairs is a federal government agency.
