Taxotere and Hair Loss

Determined Injury Lawyers Seek Compensation for Victims of Taxotere Hair Loss

Managing lawsuits for cancer patients who developed alopecia

Taxotere, also known by its active ingredient docetaxel, is a chemotherapy drug used to treat cancer of the breast, lung, prostate, stomach, head and neck. Although it is one of the most popular drugs to treat breast cancer, it has been known to cause alopecia, hair loss that may be permanent. To date, about 2,400 breast cancer survivors have filed lawsuits against the manufacturer, Sanofi-Aventis, alleging the company hid the risk of permanent hair loss. Marcari, Russotto, Spencer & Balaban is engaged in efforts to help breast cancer survivors who are victims of Taxotere. Our attorneys have more than 200 years of combined legal experience, and we fight aggressively to recover full compensation for each and every client.

Background on Taxotere breast cancer lawsuits

The U.S. Food and Drug Administration (FDA) approved Taxotere for breast cancer in May 1996. Injected into the patient, the drug works against cancer cells by inhibiting their reproduction. Taxotere soon became a hugely profitable drug for its manufacturer, garnering $1.4 billion in sales in 2004. However, the drug’s rapid growth stirred controversy, and in 2009, the FDA warned the company against presenting “unsubstantiated superiority claims” about the drug’s performance.

In 2010, reports started to surface of women who had taken Taxotere and had suffered permanent hair loss. These women stated they’d been told temporary hair loss was possible, but their hair would grow back. Without true information, these women were denied the opportunity to opt for chemotherapy that could have been just as effective but would not have caused alopecia.

The same year, the Journal of the American Academy of Dermatology noted a number of reports of permanent hair loss among chemotherapy patients who’d taken Taxotere. Five years later, the FDA added alopecia to the list of adverse effects on Taxotere’s warning label.

Holding the drugmaker accountable for hiding side effects

The lawsuits against Sanofi-Aventis allege that the company was so intent on promoting its drug that it withheld information from patients. By hiding information on permanent hair loss, Sanofi-Aventis denied patients the right to make an informed decision about their course of cancer treatment. These patients did not assume the risk of permanent hair loss because they were never given the chance.

Permanent hair loss is a compensable personal injury. Patients can recover compensation for the physical injury as well as the mental suffering due to the radical change in their appearance.
