However, failure to wear a helmet is not negligence per se, and does not automatically bar a claim under Virginia’s contributory negligence law.

    In West Virginia, the law requires all riders to wear a helmet that is securely fastened. Helmets for both motorcyclists and their passengers must meet or exceed specifications of the American National Standards Institute, the U.S. Department of Transportation, or Snell Safety Standards for Protective Headgear for Vehicle Users.
  • Helmet laws in South Carolina

    In South Carolina, riders under age 21 must wear helmets approved by the state. Failure to wear a helmet can raise questions of negligence, as defense attorneys attempt to use South Carolina’s modified comparative fault law to limit the rider’s recovery.
  • Helmet laws in North Carolina

    In North Carolina, all riders are required to wear helmets that meet federal standards. However, failure to wear a helmet is not contributory negligence per se, and does not automatically bar a claim under North Carolina’s contributory negligence law.
  • Helmet laws in Florida

    Florida law requires all riders under the age of 21 to wear helmets that meet the Federal Motorcycle Vehicle Safety Standard 218. Motorcyclists age 21 and older are exempt from wearing helmets if they carry insurance that offers a minimum of $10,000 in medical benefits.
