Our client was involved in an automobile accident on US 158, in Currituck County, North Carolina when the defendant, working in the scope of his employment, crossed the center turn lane and slammed into him head on. Our client was trapped in his vehicle for over an hour and had to be extricated by the “Jaws of Life.” He suffered multiple injuries including the permanent loss of his left eye, several broken ribs and a fractured hip which left him bedridden and required substantial at home nursing care. A lawsuit was filed. The case settled after 2 mediations were held.

Our client was injured at another’s job site when a 500-pound guardrail fell on him. There was a dispute as to whether he should have been in the area he was in. Our client was diagnosed with a severe crush injury with left tibia and fibula fractures, and perineal neuropathy. He underwent surgery at Orthopaedics East consisting of intramedullary nailing of the left tibia. The doctors opined that our client would more likely than not need an ankle replacement in the future and would be unable to return to work as a mechanic. A lawsuit was filed and the case settled at mediation.

At the time of the accident, out client was a resident of North Carolina. This accident occurred as our client was crossing the intersection of South Conduit Avenue and Springfield Blvd., in Queens, New York. At the time he was struck by the defendant, he was walking in a pedestrian crosswalk. He was crossing in a northerly direction and was struck by the defendant who was traveling in the far left lane in an easterly direction. Our client had crossed three full lanes of traffic in the crosswalk and had almost reached the sidewalk when he was fatally struck by a commercial vehicle going more than 20 miles over the speed limit.

Our client was traveling south on Highway 521 in June of 2016, when an underinsured driver crossed the median hitting our client head on. As a result of the accident our client had to undergo surgery for a fractured leg and suffered facial lacerations, scratches and bruising.

The collision, which killed our client, occurred on Princess Anne Road, in Virginia Beach, Virginia. Our client was on her way to work when the defendant fell asleep and slammed into our client car head on. The defendant was charged with involuntary manslaughter. The case settled for the available policy limits.

This collision occurred in Pender County, North Carolina. Our client was stopped eastbound on NC 53 with his turn signal activated when a vehicle operated by defendant, traveling directly behind him, failed to reduce speed and slammed into our client, causing his vehicle to slam into a tree. Following the crash, our client was transported via ambulance to New Hanover Regional Medical Center with complaints of chest wall and left elbow pain. 7 months post-accident he was admitted for lumbar decompression surgery. Afterwards he was then transferred to the nursing floor where a few hours later he was found unresponsive. Despite attempts to resuscitate our client, he died. The insurance company disputed the cause of death.

This collision occurred at the intersection of North Main Street and Rogosin Boulevard, in Lowell, NC. Our client was traveling on his motorcycle, when a vehicle operated by an underinsured motorist, failed to yield the right of way. Our client suffered multiple fractures and had to be airlifted from the scene of the accident to the hospital.

We assisted our client, a disabled Army veteran, in obtaining retroactive benefits at 100% service connection for Coronary Artery Disease, caused by Mustard Gas exposure. The veteran with his representative attended a BVA Hearing in South Carolina where the Judge remanded the case for a new exam based on new evidence and testimony presented at the hearing.

This collision occurred at the intersection of US 158 and SR 1217, in Kill Devil Hills, NC. Our client was operating a Cab when the defendant, turned left in front of her causing the two vehicles to collide. As a result of this collision, our client sustained a left frontal scalp hematoma, a fracture of the right fibula and right ankle, as well as several rib fractures and abdominal wall contusions.

Our client a 15 year veteran with the US Navy Seals was severely injured by a “Flash Bang” Grenade. The defendant manufacturer, a foreign Corporation manufactured the Grenades. On the day of the accident our client deployed the “flash bang” during a training exercise when it prematurely exploded, severely damaging his right (dominate) hand. Our client had a permanent hand injury due to this accident. His right middle finger had to be amputated as well most of his ring finger.

This collision occurred in the early morning hours at the intersection of NC 3 and Johnson Dairy Road in Iredell County, North Carolina. The defendant attempted to back his tractor-trailer into the roadway blocking the entire lane of travel. It was dark outside, there were no streetlights and the light and glare from the tractor’s headlights made it almost impossible for our client to see the defendant’s entire vehicle as he was backing. The front of our client’s vehicle collided with the side of the defendant’s trailer resulting in our client’s death. A conspicuity expert was hired and the case settled after a lawsuit was filed.

At the time of the accident, our client was traveling back to Ft. Bragg military base with friends on I-40. The driver of the vehicle lost control when one of the tires encountered a tread separation causing the vehicle to roll over. Our client, a passenger, who was seated in the middle rear of the vehicle was ejected and suffered catastrophic and ultimately fatal injuries. A lawsuit was filed against both the car and the tire manufacturer. The case settled shortly before trial.

Our 20-year-old client, was a passenger in a vehicle traveling on I-95 in Fayetteville, North Carolina flipped when it hit something in the roadway causing the tire to fail. Our client sustained multiple serious and permanent injures including an intracranial hemorrhage, a mild traumatic brain injury, a laceration of the spleen, a hip fracture, a clavicular fracture and multiple abrasions and contusions. The collision, which killed our client, occurred on I-95, in Robeson County, North Carolina. Our client was operating his 18 wheeler with a trailer full of cargo in the inside travel lane when a tractor trailer operated by the defendant, crossed the dividing line, slamming into our client’s truck. The impact caused our client to swerve off the roadway, into the guardrail and finally off the road and into the tree line. Our client left behind 3 young children and a wife.

The defendant ran a red light at the intersection of Capital Blvd and 1-540 and T-boned our client resulting in a mild traumatic brain injury, lung contusion, kidney laceration, and a fractured neck. Our client passed away two days after the accident due to injuries sustained. The case settled for the defendant’s policy limits.

Our client, age 19, was driving home to attend her mother’s birthday party. A trailer broke loose from a vehicle that was towing it and collided head on with our client’s vehicle. Our client was left with life altering injuries. She had extended hospital stays the last being the Charlotte Institute of Rehabilitation. A structured settlement was reached whereby we were able to provide monthly income to our client for life.

Our 58 year old client, who was unmarried with no children, was traveling on South Centerville Turnpike on her way to work in the early morning hours. The defendant was traveling in the opposite direction coming out of a slight curve. The vehicles hit head on. There was a dispute over who crossed over the centerline. Our client sustained massive internal injuries resulting in her death. A pre-suit mediation was held and the case was settled.

This collision occurred on SR 1369, near Maxton, N.C. Our client was traveling south on SR 1369 in his work vehicle, when a vehicle operated by the defendant, failed to reduce speed and rear-ended our client’s vehicle, forcing his vehicle to run off the roadway. Our client sustained injuries to his spine, and bilateral injuries to his arms, hands and legs.

We assisted our client, a homeless Army veteran in obtaining veterans disability benefits at a 100% rating with an effective date of 2010. We obtained an expert medical opinion from a Nephrologist. The veteran endured multiple kidney transplants and developed end stage renal disease. The veteran was granted service connection for chronic renal failure with hypertension due to scraping lead paint off of ships while in service.

This collision occurred at the intersection of Crossways Boulevard and Eden Way North, in Chesapeake, VA. Our client was traveling northbound when a vehicle operated by the defendant disregarded a stop sign causing the two vehicles to collide. Our client suffered injuries to her neck, back, knees, right hand and left shoulder.

This collision occurred at the intersection of Wilson Road and Berkley Avenue, in Norfolk, Virginia. Our client was traveling southbound on Wilson Road operating her 2007 Harley Davidson Sportster when a vehicle operated by the defendant, traveling northbound failed to yield and attempted to turn left striking our client, throwing her from the motorcycle. As a result of this collision, she sustained severe trauma to the left leg, a fracture of the transverse processes at T12 and L4, a left olecranon fracture, and an intra-articular fracture of the proximal ulna.

This collision occurred on NC 50, near Raleigh, NC. Our client was traveling north when a vehicle operated by the defendant, traveling south crossed the center line and struck our client’s vehicle, causing a chain reaction collision involving four vehicles. Our client suffered three broken bones in his ankle, a back sprain and numerous cuts, and bruises.

Our client was traveling east on Route 620 in Carroll County, Virginia, when the defendant truck driver carelessly made a left turn directly across the lane of traffic in which our client was traveling causing a violent collision. Our client suffered severe physical injuries, pain and inconvenience. She underwent several surgeries and will have permanent scarring.

Our client was stopped at a red light at the intersection of Highway 160 W and 1-77 in Fort Mill, when the defendant driver rear ended him. Our client suffered multiple injuries, the most significant being a rotator cuff tear of his left shoulder. He was diagnosed with impingement syndrome and a SLAP lesion of his left shoulder.

Our client was entering an exit ramp on I-64 when he was struck by a tractor-trailer, and was dragged along a guardrail for some distance. Our client’s vehicle was a total loss, and he suffered a lower back injury resulting in surgery. Our client was out of work for an extended period and could not return to his normal routine. A lawsuit was filed and ultimately settled before trial.

Our client was t-boned by the defendant driver on the I-664 off ramp, causing extensive damage to our client and his vehicle. Our client was transported from the scene by ambulance as a trauma patient with injuries to his back, neck, hip, and head. He underwent a lengthy physical therapy recovery process.

Our client was a minor pedestrian struck by a truck driving on Johnstown Road in Chesapeake, Virginia. The defendants’ liability was denied. We conducted a thorough investigation of the scene including the width of the roadway and dimensions of the truck. The vehicle’s mirror struck our client’s head causing a fractured skull and broken collar bone. This case settled for the available policy limits.

Our client was headed northbound on Herndon Pkwy on his motorcycle in the middle lane when the defendant driver darted out in front of him. Our client attempted to lay his motorcycle down, which crushed his left foot. Despite this evasive maneuver our client was unable to avoid the collision. During the collision our client rolled over his bike, the defendant’s hood and slid on the pavement for 10-20 feet. Our client suffered abrasions to his hands, thighs, and lower legs. This case settled for the available policy limits.

Our client was traveling east on Nine Mile Road when he stopped at a red light. The defendant was traveling west on Nine Mile Road when he struck another vehicle causing the vehicle to collide with our client. As a result of the collision, our client suffered multiple traumatic injuries including neck pain, which necessitated a C3-5 arterial cervical discectomy with fusion, cervical radiculopathy, spinal stenosis at C3-4 with cord compression, left shoulder pain, lower back pain and upper back pain. A lawsuit was filed but this case ultimately settled out of court.

The accident occurred on I-85 on the right shoulder, where the vehicle our client (1 yr.) was in was stopped. A tractor-trailer, with an overhanging load, struck the vehicle our client was a passenger in. The impact caused the vehicle to strike a guardrail before reentering the roadway in the direct path of another vehicle. Our client was fastened in her car seat which was ejected from the vehicle. Our client was diagnosed with a right distal tibial fracture, a left anterior ankle wound with exposed tendons, a laceration to her lip and abrasions to her face, chest, and legs. Our client was seen at the hospital and underwent irrigation and debridement to her left ankle and was placed in a bilateral CAM boot for several weeks. A lawsuit was filed but this case ultimately settled out of court.

Our client was helping a neighbor fix her roof, when he fell 11 feet landing on the corner of a 4×4. Our client suffered a thoracic region spinal cord injury resulting in paraplegia, a right scapula fracture, closed fracture of multiple right sided ribs and a traumatic pneumothorax. Our client had extensive medical expenses and will likely have continued medical care. This case was settled with the insurance company, for it’s policy limits.

Our client was traveling westbound on Ballahack Road in Chesapeake on his motorcycle when a vehicle operated by the defendant, traveling eastbound on Ballahack Road, suddenly made a left turn into a driveway, causing the vehicles to collide. The defendant was in the course of his employment with a pizza company. Our client sustained a left clavicle fracture, a left shoulder dislocation, closed fracture of the transverse process of lumbar vertebrae, a right medical malleolus fracture, a right second metatarsal neck fracture, a right third metatarsal neck fracture, a right fourth metatarsal head fracture, a right fifth metatarsal phalangeal joint dislocation, a right posterior heel laceration, a right knee injury and multiple abrasions and contusions over his body. He was admitted to the hospital and underwent an open reduction internal fixation of the right medial malleolus and pinning of the metatarsals. A lawsuit was filed but this case ultimately settled out of court.

Our client was traveling east on I-440 and began slowing for stopped traffic, when a vehicle operated by the defendant slammed into the rear of our client’s vehicle pushing her into the vehicle directly in front of her. Our client suffered neck pain on her right side, chest pain, right should pain, right knee pain, back pain and pain in her right forearm. Our client had to undergo an arthrodesis anterior cervical fusion, laminectomy posterior cervical decomposition and laminectomy posterior lumbar facetectomy and foraminotomy with decomposition. A lawsuit was filed, and this case ultimately settled at mediation.

Our client was traveling on South King Highway, making a right turn onto Pickett Street, when the defendant collided with the rear of our client’s vehicle. Our client sustained injuries to her back and right shoulder. She was diagnosed with a nontraumatic incomplete tear of the right rotator cuff and superior glenoid labrum lesion of the right shoulder. Our client underwent a rotator cuff repair surgery of the right shoulder arthroscopy, biceps tendinosis, surgical debridement and extensive subacromial decompression. A lawsuit was filed but this case ultimately settled out of court.

This collision occurred at the intersection of RP 1005 and RP 1262, in Dover, North Carolina. Our client was traveling westbound when a vehicle operated by the defendant, traveling southbound failed to stop at the posted stop sign and entered the intersection, causing the two vehicles to collide. Following the crash, our client was transported via ambulance to Lenoir Memorial Hospital where she was admitted with a comminuted displaced right tibial plateau, a left bimalleolar ankle fracture/dislocation and chest contusions with multiple right rib fractures.

Our client, a disabled Army veteran, claimed her Stage 4 mantel cell lymphoma (life expectancy 8 years) was caused by or related to the Gulf War & exposure to hazardous chemicals (dioxin, uranium, burn pits). She is receiving stem cell transplants and chemotherapy. The veteran was awarded 100% for mantel cell lymphoma and is currently in active treatment. Our firm was able to expedite this claim with a Decision Review Officer based on Terminal Illness and had fast results. The veteran passed away prior to the resolution of his claim, but we were able to obtain an award of accrued benefits in the amount of $309,396.24 for the spouse. The benefits were awarded for service connection of disabilities related to Agent Orange.

This collision occurred at the intersection of US 17 and Old Bridge Street, in Jacksonville, North Carolina. Our client was traveling eastbound on US 17 when the defendant rear-ended our client’s vehicle. As a result of the injuries we alleged that our client had several physical limitations and would need to control his pain through medication. The insurance company alleged that the majority of our client’s medical care was not related to this accident.

We assisted our client, a disabled Army/Vietnam veteran, in obtaining service connection for the following due to herbicide exposure to Agent Orange: diabetes mellitus Type II 20%, peripheral neuropathy right lower extremity 20%, peripheral neuropathy left lower extremity 20%, depressive disorder increased from 30% to 50%, left knee patellofemoral syndrome increased from 0% to 10%, right knee patellofemoral syndrome increased from 0% to 10%, prostate cancer increased from 0% to 20%.We also assisted the veteran in obtaining a 100% TDIU rating effective in 2015.

Our client was involved in a head on motor vehicle collision in Portsmouth, VA. His injuries include a comminuted fracture of the left wrist and left patella, a tear of the left patellar tendon and fracture of the transverse process at the L2 level of the lumbar spine. These injuries resulted in surgery with metal hardware implantation and several months of physical and occupational therapy.

This collision occurred in Rowan County, North Carolina. Our client was traveling westbound on RP 2048, when a vehicle operated by the defendant crossed the centerline slamming into our client’s vehicle. Following the crash, our client was transported by ambulance to Rowan Regional Medical Center where she underwent reconstruction and bone-grafting surgery for a right posterior wall comminuted multifragmentary acetabular fracture and dislocation.

Secondary to Diabetes Mellitus II caused by Agent Orange herbicide exposure in Vietnam. We obtained multiple medical opinions from the veteran’s head oncologist at Duke countering the VA Compensation and Pension examiner’s opinion. The veteran was terminally ill when we first accepted his case and his cancer had metastasized to other vital organs.

Our client was operating her 2006 Honda Motorcycle southbound on Highway 17 Bypass on the overpass between Halstead Boulevard and Foreman Bundy Road, near Elizabeth City, North Carolina. The windshield of the motorcycle failed suddenly and without warning, causing parts of its materials to cut into our client’s face. As a result of the faulty windshield our client suffered permanent scarring, substantial medical expenses and loss of income.

The veteran served in Iraq during Desert Storm. We represented this veteran at the Court of Appeals for Veterans Claims where we won a remand back to the Agency of Original Jurisdiction. The veteran was granted service connection and 50% for PTSD. The veteran’s PTSD was related to fear of hostile or terrorist activity and the VA failed to apply the new regulation amendment concerning this.

This collision occurred off I-40 near Hildebrand, North Carolina. Our client was traveling east when a vehicle operated by the defendant, also traveling east failed to reduce speed and collided with our client’s vehicle causing a three vehicle collision. Our client suffered injuries to her neck and back, specifically cervical and lumbar disc protrusions, cervical and lumbar spondylosis, muscle spasms and a rotator cuff tear. Her treatment consisted of a hospital visit, several primary care doctor visits and orthopedic visits as well as a neurosurgeon visit.

We assisted our client, a disabled retired Air Force veteran, in obtaining retroactive benefits at a 100% rating from March 23, 2008 to present. We also assisted with multiple claims for service connection and increased ratings. We attended a Board of Veterans’ Appeals hearing in July of 2015 where the attorney won an increased rating for mesenteric panniculitis (10%>60%) and additional remands for entitlement to TDIU and service connection for Sleep Apnea which were later awarded by the Regional Office on January 20, 2017 in addition to Special Monthly Compensation.

This collision occurred at toll plaza, in Chesapeake, VA. Our client was operating his motorcycle northbound approaching the toll plaza, when a vehicle operated by the defendant failed to look before changing lanes and pulled directly into the direct path of our client. As a result of the crash, our client sustained spinous process fractures at T5-T10, fractures of the transverse process of the lumbar vertebra at L2-L5, a pelvic fracture, traumatic rupture of the bladder, a right finger fracture and a scalp laceration.

This accident occurred on Interstate 95 in Caroline County, Virginia. Our client was driving his tractor-trailer in the right travel lane when the defendant, traveling in the center lane, drove into the right lane, and ran into another vehicle. After this initial collision, the defendant lost control of her car, and drove across all three lanes, overcorrected and drove back slamming into the driver’s side of our client’s truck causing his rig to overturn. Our client was diagnosed with left hand and wrist contusions, cervical sprain, lumbar sprain, right shoulder sprain, traumatic bursitis of the right shoulder, and a right knee contusion.

Our client, a disabled Marine veteran, received a gunshot wound to the head while in the service and suffered from PTSD and gunshot wound residuals including a fractured skull. Our firm obtained a medical opinion switching his diagnosis and rating from depressive neurosis to PTSD in addition to asking for 100% TDIU.

Our client was involved in an accident at the intersection of Spring Forest Road and Fox Road in Raleigh, NC. Our client was entering the intersection, when a vehicle operated by the defendant failed to yield the right of way and pulled in front of our client, causing the collision. Our client suffered right wrist pain, wrist sprain/strain, neck pain, cervical sprain/strain, chest pain, right ankle pain, ankle sprain/strain, head pain and chipped tooth. A lawsuit was filed but this case ultimately settled out of court.
